Location: a) On the fourth level of the exterior fire escape in the courtyard on the Seabreeze Avenue side: On or about February 14, 2024, employees were replacing parts on an exterior fire escape that had the guardrail system removed. The employees used a portable hand grinder without a guard to cut the guardrail system.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. Location: a) On the fourth level of the exterior fire escape in the courtyard on the Seabreeze Avenue side: On or about February 14, 2024, employees were replacing parts on an exterior fire escape that had the guardrail system removed. The employees were exposed falling up to approximately 30 feet to a lower level and was not protected from falling by the use of guardrails, safety nets, or personal fall arrest systems.

29 CFR 1926.850(a): An engineering survey was not performed by a competent person to determine the conditions of the structure and the possibility of unplanned collapse of any portion of the structure prior to permitting employees to start demolition operations. Location: a) On the fourth level of the exterior fire escape in the courtyard on the Seabreeze Avenue side: On or about February 14, 2024, employees were demolishing and replacing parts on an exterior fire escape when the fourth-floor platform broke, causing one of the employees to fall from the fourth-floor platform to the ground level. An engineering survey was not performed by a competent person to determine the structural stability of the exterior fire escape prior to permitting employees to start demolition operations.
