OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment that were free from recognized hazards and were causing or likely to cause death or serious physical harm to employees:  On or about February 6, 2024, at a worksite located at 2425 Road DD Satanta, KS 67870 the employer exposed an employee to struck by and crushing hazards associated with working next to and under a load. The employer used a 2014 Bobcat Excavator E35i AUYM11678, 1092471, equipped with a three-tine grapple to lift and unload a 400-pound auger from a trailer. During the lift, an employee stood next to the trailer with one hand braced on the trailer and the other on the Auger trying to prevent it from sliding, tipping, twisting, or shifting as it was being unloaded. The lifted Auger twisted and slipped, causing the Auger sharp point to crush the employee's top left ring finger and break the middle finger. The crushed ring finger was later medically amputated.   Feasible and acceptable abatement methods include:  1. Take steps to ensure employees are not exposed to struck by and crushing hazards when using excavators to unload equipment, including training employees to stay away from moving equipment and raised loads as indicated in the equipment manufacturer's manuals. Both the Bobcat Excavator E35 Operator Handbook and the Operation & Maintenance E35 Excavator Manuals warn that there should not be anyone near the equipment when in operation:  a. Pages 25 and 32, "Keep bystanders away from the work area." b. Page 64, "Do Not work or stand under raised work equipment or attachment." c. Pages 79, 88, 112, 227, and 229, "Keep all bystanders 6 m (20 ft) away from equipment when operating."  2. Create procedures and policies for lifting heavy loads using lifting devices approved for the lift.  a. Ensure procedures and policies follow equipment manufacturers' guidelines. b. Train employees to understand load lift policies and lift hazards.  c. Ensure employees can effectively use load-lifting procedures.  d. Require employees to follow lift procedures and policies. e. Implement disciplinary action when a procedure or policy is not followed.
