29 CFR 1910.95(c)(1):A continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (n) was not instituted when employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 dBA: Manufacturing Area: a) Filler Area: An employee who monitored dessert pneumatic manufacturing filling equipment was exposed to a continue noise level at 127% of the allowable 8-hour time weighted average sound level (80dBA). The equivalent dBA level of 127% is approximately 90.7 dBA. The sampling was performed during 548 minutes of an extended work shift. b) Packing Area: An employee who monitored dessert pneumatic manufacturing packing equipment was exposed to a continue noise level at 88.7 % of the allowable 8-hour time weighted average sound level (80 dBA) The equivalent dBA of 88.7% is approximately 88.2 dBA. The sampling was performed during 542 minutes of an extended work shift. C) Mixing Area: An employee who feed dry and wet ingredients into dessert manufacturing equipment was exposed to a continue noise level at 97.3% of the allowable 8-hour time weighted average sound level (80dBA). The equivalent dBA level of 97.3% is approximately 89.1dBA. The sampling was performed during 525 minutes of an extended work shift. The employer did not administer a continuing effective hearing conservation program, thus exposing employees to irreversible hearing loss, on or about 2/15/2024. Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
