29 CFR  1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent material or equipment from falling or rolling into excavations, or by a combination of both if necessary:  On or about February 15, 2024, near the intersection of Margate Blvd. and E. River Drive, Margate, Florida, an employee was exposed to struck-by and caught-between hazards when replacing a water pipe inside a trench while working adjacent to spoil pile materials and equipment that were closer than 2 feet from the trench walls.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  On or about February 15, 2024, near the intersection of Margate Blvd. and E. River Drive, Margate, Florida, an employee was exposed to struck-by, caught-between, and asphyxiation hazards while replacing a water pipe inside a 6 feet deep trench without a means of cave-in protection.

29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  On or about February 15, 2024, near the intersection of Margate Blvd. and E. River Drive, Margate, Florida, the employer did not remove an employee from a 6-foot deep pre-disturbed soil trench while the worker was exposed to struck-by, caught-between, and asphyxiation hazards due the trench lacking a means of cave-in protection and having spoil pile materials and equipment positioned within 2 feet from the walls of the trench.

29 CFR  1910.1200(b)(4)(ii): In work operations where employees only handled chemicals in sealed containers which were not opened under normal conditions of use, the employer did not ensure that the safety data sheets were readily accessible during each work shift to employees when they are in their work area(s):  On or about February 15, 2024, near the intersection of Margate Blvd. and E. River Drive, Margate, Florida, an employee replacing a water pipe did not have the "PROSELECT" pipe joint lubricant's safety data sheet (SDS) readily available onsite.
