29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.   (a) 415 Route 73 N., Berlin, NJ: Workers engaged in framing and other related activities was exposed to fall hazards, up to and in excess of 26 feet to the ground surface below, when walking on and working from the roof and balcony of a residential structure and climbing over unprotected openings without the use of fall protection. Condition noted on or about 02/15/2024.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) 415 Route 73 N., Berlin, NJ: Workers engaged in framing and other related activities was exposed to fall hazards, up to and in excess of 26 feet to the ground surface below, when walking on and working from the roof and balcony of a residential structure without the use of fall protection. Condition noted on or about 02/15/2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a) 415 Route 73 N., Berlin, NJ: Workers were not trained to recognize hazards and unsafe conditions while working at the site. Owner could not verify if his employees were trained in fall protection.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
