29 CFR 1926.404(f)(6): Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.   On or about February 14, 2024, to February 15, 2024, at a worksite located at 3415 Calumet Avenue in Manitowoc, Wisconsin; employees of Concrete Finishers Inc. were exposed to electrical shock hazards while using a Ruwac HEPA vacuum when the ground pin was missing.

29 CFR 1926.405(b)(2): Covers and canopies. All pull boxes, junction boxes, and fittings shall be provided with covers. If metal covers are used, they shall be grounded. In energized installations each outlet box shall have a cover, faceplate, or fixture canopy. Covers of outlet boxes having holes through which flexible cord pendants pass shall be provided with bushings designed for the purpose or shall have smooth, well-rounded surfaces on which the cords may bear.  On or about February 14, 2024, at a worksite located at 3415 Calumet Avenue in Manitowoc, Wisconsin; employees of Concrete Finishers Inc. were exposed to electrical shock hazards while using an outlet without a cover to power a concrete joint saw.

Flexible cords shall be connected to devices and fittings so that strain relief is provided which will prevent pull from being directly transmitted to joints or terminal screws.   On or about February 14, 2024, to February 15, 2024, at a worksite located at 3415 Calumet Avenue in Manitowoc, Wisconsin; employees of Concrete Finishers Inc. were exposed to electrical shock hazards while using a Ruwac HEPA vacuum when the ground pin was missing.

29 CFR  1926.1153(c)(1): Specified exposure control methods. For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  On or about February 15, 2024, at a job site located at 3415 Calumet Avenue in Manitowoc, Wisconsin; the employer did not properly implement the engineering controls, work practices, and respiratory protection specified in Table 1 (iv) for walk-behind concrete joint saws. Employees were exposed to the health effects of respirable crystalline silica when they were not provided respiratory protection while utilizing a walk-behind joint saw that did not have an integrated water delivery system.

The employer shall assess the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section.   On or about February 15, 2024, at a job site located at 3415 Calumet Avenue in Manitowoc, Wisconsin; the employer did not assess the exposure of each employee who was reasonably expected to be exposed to respirable crystalline silica at or above the action level. Employees were dry sweeping concrete dust and did not have respiratory protection donned while utilizing a walk-behind concrete joint saw that was not equipped with an integrated water delivery system.

The employer shall not allow dry sweeping or dry brushing where such activity could contribute to employee exposure to respirable crystalline silica unless wet sweeping, HEPA-filtered vacuuming or other methods that minimize the likelihood of exposure are not feasible.  On or about February 15, 2024, at a job site located at 3415 Calumet Avenue in Manitowoc, Wisconsin; the employer did not prohibit employees from dry sweeping where such activity could contribute to employee exposure to respirable crystalline silica.

The employer shall ensure that each employee covered by this section can demonstrate knowledge and understanding of at least the following:  A) The health hazards associated with exposure to respirable crystalline silica;  B) Specific tasks in the workplace that could result in exposure to respirable crystalline silica; C)Specific measures the employer has implemented to protect employees from exposure to respirable crystalline silica, including engineering controls, work practices, and respirators to be used;  D) The contents of this section;  E) The identity of the competent person designated by the employer in accordance with paragraph (g)(4) of this section; and F) The purpose and a description of the medical surveillance program required by paragraph (h) of this section.   On or about February 15, 2024, at a job site located at 3415 Calumet Avenue in Manitowoc, Wisconsin; the employer did not assess the exposure of each employee who was reasonably expected to be exposed to respirable crystalline silica at or above the action level.
