29 CFR 1910.266(h)(1)(iv):Employee(s) approached a feller closer than two tree lengths of trees being felled without the feller acknowledging that it was safe to do so: Site- On or about February 15, 2024, an employee walking through the drop zone of a tree being felled by the employer was struck and seriously injured, requiring hospitalization. The employee was struck approximately 25 feet from the base of the tree where the employer had completed the cut and felled the tree, the tree was approximately 55 feet in height.

29 CFR 1910.266(h)(2)(ii): Before each tree is felled, conditions such as, but not limited to, snow and ice accumulation, the wind, the lean of tree, dead limbs, and the location of other trees, was not evaluated by the feller and precautions taken so a hazard is not created for an employee. Site- On or about February 15, 2024, an employee walking through the drop zone of a tree being felled by the employer was struck and seriously injured, requiring hospitalization. The employer did not clear small pine trees inside the drop zone creating an obstructed view where the employer and the injured employer could see each other prior to the incident.
