29 CFR  1910.30(a)(3)(iv): The employer did not train each employee in the correct use of personal fall protection systems and equipment specified in paragraph (a)(1) of this section, including, but not limited to, proper hook-up, anchoring, and tie-off techniques, and methods of equipment inspection and storage, as specified by the manufacturer.  a) 10 East Park Drive, Westampton, NJ: Employees were exposed to fall hazards of approximately 8 feet to the ground below when loading carpets onto a the work platforms of a Clark Forklift Model #TMX25 and Model #S25CL.   The employees improperly attached the lanyard to the forklift by wrapping it around the frame and not utilizing a proper anchor point. The employer did not provide training on the correct use of fall protection and how to properly anchor to the lift for protection from falls. Observed on or about  02/20/2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.

29 CFR 1910.140(c)(12): The employer did not ensure that anchorages used to attach to personal fall protection equipment are independent of any anchorage used to suspend employees or platforms on which employees work. The employer did not ensure that anchorages used to attach to personal fall protection equipment on mobile work platforms on powered industrial trucks are attached to an overhead member of the platform, at a point located above and near the center of the platform.  a) 10 East Park Drive, Westampton, NJ: Employees were exposed to fall hazards of approximately 8 feet to the ground below. The employees were observed in the process of loading carpets unto the work platforms. The employees were wearing safety harnesses and connected to the Clark Forklift Model #TMX25 and Model #S25CL. One employee's connection point was at chest level while the other employees' connection point was at knee level. Observed on or about  02/20/2024   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.

29 CFR  1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  a) 10 East Park Drive, Westampton, NJ: Employees were exposed to fall and crush hazards. Two employees were observed utilizing unapproved blue work platforms supported by Powered Industrial Trucks. Employees were at a height of 7 to 8 feet above the ground. In addition, throughout the facility the blue work platforms could be observed loaded with carpets that were being processed. Observed on or about 02/20/2024.  b)10 East Park Drive, Westampton, NJ: employees were exposed to fall and crush hazards. An employee was observed utilizing an unapproved blue work platform supported by a Powered Industrial Truck. The tines on the forklift exceeded the length of the work platform changing center of gravity and capacity. Modifications made without approval. Observed on or about 02/20/2024.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.

29 CFR  1910.178(o)(1): Load(s) on powered industrial truck(s) were not stable or safely arranged:  a) 10 East Park Drive, Westampton, NJ: An employee was observed exposed to a fall hazard of approximately 7 to 8 feet to the floor below. A work platform was being used and not secured to the forklift. Tines were not in the proper channel causing the platform to be unstable. Observed on or about  02/20/2024  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.
