29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Lower rooftop between the two towers of the building, 955 Sterling Place, Brooklyn, NY 11213 On or about February 21st, 2024, an employee was working on the lower rooftop between the two towers of the building without fall protection and was exposed to falling approximately 15 feet from the rooftop to the ground level below.

29 CFR 1926.502(d)(6)(ii): A snaphook not of the locking type was engaged (i) directly to webbing, rope or wire rope; (ii) to each other (iii) to a Dee-ring to which another snaphook or other connector is attached;(iv) to a horizontal lifeline; or (v) to any objectwhich is incompatibly shaped or dimensioned in relation to the snaphook such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself. a) Lower rooftop between the two towers of the building, 955 Sterling Place, Brooklyn, NY 11213 On or about February 21st, 2024, an employee was working on a rooftop. His fall arrest lanyard's snaphook was connected to another snaphook.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) Lower rooftop between the two towers of the building, 955 Sterling Place, Brooklyn, NY 11213 On or about February 21st, 2024, an employee was exposed to a fall hazard of 16 feet to the ground below while working on the rooftop. The fall arrest system could not prevent the worker from contacting the next lower level or limiting the free fall to not more than six feet.
