OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, such as struck-by and crush-by hazards:   a) Jobsite located at 200 Liberato Drive Spring City, PA 19475 - On February 22, 2023, employees were working within the vicinity of an industrial steel racking system with columns that that was not anchored to the floor. The racking system was used to store material used to manufacture metal structures, exposing employees working near the racking system to tip-over/crushing hazard, and falling object hazards.

29 CFR  1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:  (a) Jobsite located at 200 Liberato Drive Spring City, PA 19475 - On or about February 22, 2024, the employer failed to ensure an evaluation of each powered industrial truck operator's performance was conducted at least once every three years, thereby exposing employees to struck-by hazards.  Training shall consist of a combination of formal instruction, practical training, and evaluation of the operator's performance in the workplace.
