29 CFR 1910.133(a)(1):  The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a.  On or about February 13, 2024, at the North wall, the employer did not enforce the use of safety goggles and/or face shields when employees were required to perform service and/or maintenance, to include inspecting, the closed loop chiller system containing ethylene glycol.  Employees were thereby exposed to eye, skin and ingestion hazards associated with ethylene glycol.

29 CFR 1910.147(c)(7)(i)(A):  Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation.  a.  On or about February 13, 2024, at the North wall, employees were required to service and maintain equipment, to include inspecting, the closed loop water system, without the knowledge and skills required for the safe application, usage and removal of energy control devices.  Employees were thereby exposed to hazards associated with not being trained as an authorized employee.

29 CFR 1910.147(d):  The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6).  a.  On or about February 13, 2024, at the North wall, employees were exposed to eye, face, skin and ingestion hazards while conducting service and/or maintenance on the closed loop water system containing ethylene glycol.  The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements].  As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from servicing hazards.

29 CFR 1910.1200(h):  Employees were not provided effective information and training as specified in 29 CFR 1910.1200(h)(1) and (2) on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard was introduced.  a.  On or about February 13, 2024, at the North Wall, employees required to service and maintain the process water reclamation system, containing ethylene glycol, were not provided with adequate information and training on hazardous chemicals.   Employees were thereby exposed to the hazards associated with ethylene glycol.

On or about February 13, 2024, in the facility, the employer failed to certify that a workplace hazard assessment had been performed.  Employees were exposed to hazards that required the use of personal protective equipment, including, but not limited to eye, face, skin and ingestion protection.
