29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) 350 Anchor Mill Road New Castle, DE: On or about February 29, 2024, employees were exposed to a corrosive chemical products leaking from batteries [e.g. car, industrial trucks, etc.] within the warehouse which according to the SDS contains hydrochloric acid and did not have an eye wash station or suitable facilities for quick drenching or flushing of the eyes and body within 150 feet of the storage area.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a) 729 Dawson Road Newark, DE: On or about March 6, 2023, the employer did not implement a written hazard communication program for their employees who were involved in the storage of a hazardous product which contained Sulfuric acid [e.g. H2SO4] which has been identified as chemical which is capable of causing sever burn to the skin such as thermal. NOTE: A written program shall include descriptions of how the criteria for the following will be met: 1. Labeling and other forms of warning 2. Safety Data Sheets 3. Employee information and training Additionally a list of Hazardous chemicals known to be present in the work place must be compiled. Methods used to inform employees of the hazards associated with non-routine task. The written program must be made available upon request.

29 CFR 1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet. a)350 Anchor Mill Road New Castle, DE: On or about February 29, 2024, a hazardous chemical listing of all of the hazardous products [e.g. which include the used batteries] being stored in the workplace were not compiled. The batteries received within the warehouse are periodically damaged upon being stored within the wherehouse brought in by the owner Clarios. These batteries are lead-acid filled batteries which are composed of sulfuric acid [H2SO4}.

29 CFR 1910.1200(g)(1): The employer did not have a safety data sheet in the workplace for each hazardous chemical which they use: a) 350 Anchor Mill Road New Castle, DE: On or about February 29, 2024, employees did not have access to Safety Data Sheets for the hazardous chemical products including sulfuric acid stored in the warehouse. Safety data sheets for the powered industrial trucks and automobile batteries being stored and leaking on the surface floor of the warehouse were not available upon request.
