29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about February 21, 2024, and before, the employer failed to train employees on the operation of powered industrial trucks exposing employees to struck-by hazards and improper loading and unloading of chemicals and other goods. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1910.1200(b)(4)(iii): In work operations where employees only handle chemicals in sealed containers which are not opened under normal conditions of use, the employer did not ensure that employees were provided with information and training in accordance with 29 CFR 1910.1200(h) to the extent necessary to protect them in the event of a spill or leak of a hazardous chemical for a sealed container: On or about February 21, 2024, the employer failed to train employees on Safety Data Sheets, the location of the Safety Data Sheets to be readily accessible to employees, and how to safely clean a spill or leak of a hazardous chemical such as, but not limited to, hydrogen peroxide. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
