29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that employees acquired the knowledge and skills required for the safe application, usage and removal of energy control devices:  a) Production Area - On February 21, 2024, the employer did not ensure employees  who unjam the Three Pack Conveyor Line Machine,  were trained as Authorized lockout employees.  Employees performed this servicing and maintenance task without the knowledge and skills needed for the safe application, usage, and removal of the energy controls.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a) Production Area - On February 21, 2024, an employee was exposed to machine hazards associated with rotating parts during unjamming of the Three Pak Conveyor Line Machine.  The employer failed to implement energy control application steps as the machine was not locked out to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to protect the employee from machine servicing hazards.   In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  a) Chocolate Room - On or about February 21, 2024,  the employer did not ensure that the roller at the end of the Line #4, Eriez, model #20X8, serial #3411265, with the ingoing nip points were completely guarded. The receptacle box was installed from a flexible cord on top of D4 conveyor machine, and Leeson Spin Master Machine.    a) Production Area - On February 21, 2024, the employer did not ensure that the four outlet receptacle metal box on the Thermo Line was installed in accordance with the instructions included in its listing or labeling.  The receptacle box was installed from a flexible cord on top of D4 conveyor machine, and Leeson Spin Master Machine.   No abatement certification or documentation is required for this item.

29 CFR 1910.305(j)(2)(iv): A receptacle installed in a wet or damp location was not suitable for the location:  a) Apple Dipping Room - On February 21, 2024, the employer did not ensure that the duplex and four outlet electrical box was suitable for wet or damp locations near a water source.  Employees used the water source near the outlet to wash apples and other materials.    In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
