29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use: On or about February 26, 2024 the employer Stephens Construction LLC at jobsite 10705 Fremont Pike Perrysburg OH 43551, did not ensure a DeWalt brand angle grinder (Model: DCG412. S/N: DCW061W) was equipped with the appropriate factory installed guard while in use. Employees using the DeWalt angle grinder in the unguarded condition to cut rebar and conduit while conducting commercial demolition operations were exposed to potential struck-by, laceration and amputation injuries from the unguarded blade during cutting operations.

29 CFR 1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways: On or about February 26, 2024 the employer Stephens Construction LLC at jobsite 10705 Fremont Pike Perrysburg OH 43551, did not provide a training program for each employee potentially exposed to fall hazards while using a portable ladder to enable each employee to recognize the hazards of falling from the ladder and the procedures to be followed in order to minimize these hazards. Four employees were exposed to falls from approximately 6 - 8 feet or greater while using a Werner brand fiberglass ladder to perform commercial rehabilitation and renovation construction activities.
