29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  (a) On or about February 27, 2024, at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI. the employer did not ensure that the competent person was conducting frequent and regular inspections of the job site to ensure  that hazardous conditions were identified and corrected. Hazards identified included but were not limited to: fall protection was not being worn, fall protection systems were not  properly installed,  ladders were not installed and/or used properly, Personal Protective Equipment was not being worn to include hard hats and safety glasses when required, and all-terrain forklifts were not properly used when elevating workers.

29 CFR  1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a) On or about February 27, 2024, at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI. the employer did not ensure that the employee assisting in framing operations (ground worker) was protected from potential falling objects from above by the use of a protective helmet. This exposed the employee to a struck-by hazard from a height of up to 25 feet by items that include but are not limited to material remnants and tools being used above the employee (ground worker) located at the back of the residential structure on the West side as he assisted in construction activities.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about February 27, 2024,  at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI, employees operating portable tools to include pneumatic nail guns and battery powered circular saws while framing a residential structure were not wearing safety glasses. This  exposed employee(s) to a struck by hazard to the eyes which can result in temporary and or permanent vision loss, blindness, or the loss of an eye.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph         1926.501 (b):  (a) On or about February 27, 2024,  at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI,  employees conducting decking and framing work on a 8:12 pitch roof were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 25 feet onto dirt, gravel, and building material on the West side of the structure at the back of the house, and eleven (11) feet, eight (8) inches on the East side of structure near the front door.

29 CFR  1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet or more above lower levels and the inside bottom edge of the wall opening.  (a) On or about February 27, 2024, at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI,  employees were working in the first floor area of the structure framing without fall protection while located  at or near two exterior access holes (a door and a window) located on the  West side of the structure. This exposed employees to a fall hazard of approximately six (6) feet four (4 ) inches onto dirt and building materials.

29 CFR  1926.602(c)(1)(viii)(A): The industrial truck was not equipped with a safety platform/cage firmly secured to the lifting carriage and/or forks when used for lifting personnel:   (a) On or about February 27, 2024,  at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI, an employee  was working suspended from the forks of an all terrain fork lift, while standing on a  four (4) foot by eight (8) foot sheet of decking material  that was laying on, but not secured to the forks or lifting carriage of the all terrain forklift. This exposed the employee to a tip and fall hazard to the lower level of approximately 14 feet.

29 CFR 1926.1053(b)(1): Where a portable ladder(s) was used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.    (a) On or about  February 27, 2024, at a new construction residential jobsite located at 7527 S. 49th Ct, Franklin WI,  the Werner Extension  ladder erected on the East side of the structure, at the garage, being used for access to the 8:12 pitched roof, did not extend at least three (3) feet above its upper contact point, and/or was not secured to the structure when it was not sufficiently extended. This exposed employees accessing the roof  to a fall hazard of approximately 11 feet, 8 inches onto a gravel covered surface.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purpose for which they were designed:  (a) On or about February 27, 2024, employee(s) working on a framed residential structure did not insure an six (6) foot self supporting portable step ladder used to access the first floor from ground level was used as designed. The six (6) foot step ladder was left in the closed position and leaned against a framed wall, while the employee used the ladder rungs to step on while reaching up to hand sheets of  material to a worker above. This exposed the employee to a tipping and fall hazard.
