29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m), or more above lower level were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501. Site: 246-12 86 Avenue, Jamaica, NY 11426. On or about February 29, 2024, employees working on a residential roof approximately 30-feet above the lower level replacing shingles were not protected from falling to the lower level. Repeat Violation Note: Eagle Roofing Contractor Inc. was previously cited for a violation of this occupational safety and health standard 1926.501(b)(13) or its equivalent, which was contained in OSHA inspection 1532983, citation number 1, item number 2, issued on 11/12/2021, and was affirmed as final order on 12/28/2021, with respect to a workplace located at 248-19 83rd Avenue Bellerose, NY 11426. Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.503(a)(1): Employer did not provide a training program for each employee who were exposed to a fall hazards, and the employer did not have a program to allow each employee to recognize the hazards of falling and the procedure to be followed in order to minimize these hazards. On or about February 29, 2024, the employer failed to provide training to each employee that were required to work from a height of approximately 30-feet above the ground level and were exposed to fall hazard. Abatement certification is required pursuant to 29 CFR 1903.19.
