CFR 1910.106(b)(6):"Sources of ignition." In locations where flammable vapors may be present, precautions shall be taken to prevent ignition by eliminating or controlling sources of ignition. Sources of ignition may include open flames, lightning, smoking, cutting and welding, hot surfaces, frictional heat, sparks (static, electrical, and mechanical), spontaneous ignition, chemical and physical-chemical reactions, and radiant heat.  860, Production Floor: On or about February 20, 2024, employees were exposed to fire hazards.  A flash fire resulted when employees were mixing and  heating chemicals such as Durazane 1033, a corrosive and flammable liquid.  Employees were heating  Durazane 1033 using a hot plate when the liquid overflowed and touched the hot place. The employer failed to ensure that sources of ignition were kept away from flammable vapors.  Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  1. Requirement for labeling and other forms of warning; 2. Safety data Sheets; 3. Employee information and training. 4. A list of hazardous chemicals known to be present in the workplace; 5. Methods to inform employees of the hazards on non-routine tasks;  a.  On or about February 20, 2024, employees were exposed to fire hazards.  A flash fire resulted when employees were mixing and  heating chemicals such as Durazane 1033, a corrosive and flammable material.  Employees were not aware of the hazards of Durazane 1033. The employer did not develop or implement a Hazard Communication program that includes the above mentioned elements.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace:  On or about February 20, 2024, employees were required to wear 3M Half Face respirator 6503QL while mixing products RM -078 and RM 041.  The employees were not medically evaluated to determine the employee's ability to use a respirator before the employee is fit tested, or required to use the respirator in the workplace.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1910.151(c):Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use.  860, Production:  On or about February 20, 2024, through March 28, 2024,  employees were mixing chemicals, such as but not limited to Durazane 1033 and Marine EcoWash, both corrosive chemicals.  There were no suitable facilities in the vicinity of the production floor to quickly drench the skin of the employees in the event of exposure to corrosive substances in the production room.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

On or about February 20, 2024, employees were exposed to fire hazards.  A flash fire resulted when employees were mixing and  heating chemicals such as Durazane 1033, a corrosive and flammable material.  The employer failed to provide training to familiarize employees with general principles of fire extinguisher use and the hazards associated with incipient stage fire fighting, exposing employees to potential thermal injuries.  Abatement certification is required of this item in accordance with CFR 1903.19(c).
