29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun:  a)  At 21444 Yosemite Boulevard, Lot 39 Fairhope Falls, Fairhope, Alabama:  On February 29, 2024; the employer allowed his employee to operate a pneumatic nail gun without eye protection while performing framing activities.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  At 21444 Yosemite Boulevard, Lot 39 Fairhope Falls, Fairhope, Alabama:  On February 29, 2024; the employer allowed his employee to perform framing activities without first ensuring his employee was trained on the hazards associated with falls to include but not limited to setting up and inspecting fall protection exposing his employee to a fall hazard of 8 feet  8 inches to the ground below.

29 CFR  1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a)   a)  At 21444 Yosemite Boulevard, Lot 39 Fairhope Falls, Fairhope, Alabama:  On February 29, 2024; the employer allowed his employee to perform framing activities without fall protection exposing his employees to a fall hazard of 8 feet 8 inches to the ground below.  The Axel Chairez dba Axel Chairez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1026.501(B)(13), which was contained in OSHA inspection number 1714566, citation number 1, item number 1 and was affirmed as a final order on February 12, 2024, with respect to a workplace located at 21570 Yosemite Boulevard, Lot 49 Fairhope Falls, Fairhope, Alabama.
