29 CFR 1910.178(a)(4):Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a) On or about February 28, 2024, the employer did not obtain the manufacturers prior written approval for modifications of the forklift attachment. In that the forklift attachment had been modified by placing a hole in the center of the fork and used to tow un-operational forklifts from trailers. As a result employees were exposed to crushed-by and struck-by hazards.

Powered industrial truck operators shall receive initial training in the following topics, except in topics which the employer can demonstrate are not applicable to safe operation of the truck in the employer's workplace: Fork and attachment adaptation, Operating limitations; a) On or about February 28, 2024, the employer did not ensure that employees were adequately trained on the modified tow fork attachment. Employees were not instructed on site-specific operations on towing damaged forklifts using the modified tow fork attachment or its limitations, as a result employees were exposed to crushed-by & pinch-point hazards.

On or about February 28, 2024, the employer did not ensure employees were not operating forklifts that had been placed out of service, in that an employee was permitted to manually steer a forklift while it was being unloaded from a trailer exposing them to struck-by & crushed-by hazards.

29 CFR 1910.178(q)(7):Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. a.) On or about February 28, 2024, the employer did not ensure employees were examining forklifts before they operated them to remove them from semi-trailers exposing them to struck-by and caught-by hazards.
