Employers and building and facility owners did not exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM: (a) Store Floor: On or about March 1, 2024, the building owner had not determined the presence of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) in the workplace in areas such as, but not limited to, the floor tile and had not informed employees about its presence and location.
