29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1: Ocean State Job Lot: On or about March 01, 2024, for each employee engaged in a task identified in Table 1, such as the operation of heavy equipment including an S630 Bobcat Skid-Steer Loader and a Wacker Neuson EZ36-MX Tracked Zero Tail Excavator, when the equipment was used to demolish and break silica-containing materials such as concrete slab, the employer did not fully and properly implement the engineering controls and work practices specified for the 1926.1153(c)(1)(xvii) Table 1 task.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan: Ocean State Job Lot: On or about March 01, 2024, the employer did not establish and implement a written exposure control plan for workers who were tasked to operate heavy equipment including, but not limited to, the Wacker Neuson EZ36-MX Tracked Zero Tail Excavator used to demolish silica-containing materials such as concrete slab. Equipment operators, and the employees working in the area, were exposed to silica dust hazards that were generated by heavy equipment activity.

29 CFR 1926.1153(g)(4): The employer did not designate a competent person to make frequent and regular inspections of job sites, materials, and equipment to implement the written exposure control plan: Ocean State Job Lot: On or about March 01, 2024, for each employee engaged in a Table 1 task identified in 1926.1153(c)(1)(ii) and 1926.1153(c)(1)(xvii) using heavy equipment (S630 Bobcat Skid-Steer Loader) and a handheld power saw (Husqvarna's power cutters), the employer did not designate a competent person to make frequent and regular inspections of job sites, materials, and equipment to implement the written exposure control plan.
