29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. Located at 9091 Sun Gold Loop, Reynoldsburg, Ohio, 43068: On or about March 03, 2024, the employer failed to ensure the employees were wearing appropriate eye protection while operating pneumatic nail guns to install roof sheathing on a new build apartment building.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. Located at 9091 Sun Gold Loop, Reynoldsburg, Ohio, 43068: On or about March 03, 2024, the employer did not ensure employees were protected from falls by use of guardrail systems, safety net systems, or personal fall arrest systems while those employees were  installing roofing sheathing on a new build residential apartment building.  The non-use of fall protection exposed the employees to falls of up to approximately 18 feet to the ground below.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. Located at 9091 Sun Gold Loop, Reynoldsburg, Ohio, 43068: On or about March 03, 2024, the employer failed to provide employees with any fall protection training programs for the recognition of fall hazards and procedures to be followed to minimize these hazards, thereby exposing employees to fall hazards of up to 18 feet.

Located at 9091 Sun Gold Loop, Reynoldsburg, Ohio, 43068: On or about March 03, 2024, the employer did not ensure that an employee operating a Genie GTH-844 all-terrain forklift was competent to operate the machine through successfully completing training and evaluation prior to using the equipment at the jobsite, exposing employees to struck-by hazards.

29 CFR  1926.404(b)(1)(iii)(C):Each cord set, attachment cap, plug and receptacle of cord sets, and any equipment connected by cord and plug, except cord sets and receptacles which are fixed and not exposed to damage, shall be visually inspected before each day's use for external defects, such as deformed or missing pins or insulation damage, and for indications of possible internal damage. Equipment found damaged or defective shall not be used until repaired.  a. Located at 9091 Sun Gold Loop, Reynoldsburg, Ohio, 43068: On or about March 03, 2024, the employer failed to ensure that the extension cords being used power the air compressors were inspected before use thereby exposing the employees to 120-volt electrical shock hazard.
