29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied. On or about March 1, 2024, and times prior thereto, employees conducted single home residential framing operations using a platform elevated greater than ten feet above a lower level by a rough terrain forklift and the platform was not attached to the forks. This condition exposed employees to fall from height.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about March 1, 2024, and times prior thereto, employees conducted single residence framing with employees on an elevated platform with no guardrails or fall protection. This conditions exposed employhee to falls greater than 10 feet to the next lower level.

1926.20(b)(2) Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers. On or about March 1, 2024, and times prior thereto, the rough terrain forklift truck operator was not trained and evaluated as required. As a result, the employer allowed employees to be repeatedly lifted on an elevated platform carrying roofing rafters to the second story level for roof installation. This exposed employee to fall from elevated levels greater than 10 feet to the next lower level.
