OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:  a)At the worksite, located at 15400 Willow Ridge Drive, Montverde, FL 34756; On or about 1/22/24, the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, an employee was exposed to lacerations and amputations while operating a Stihl cut-off saw to cut pavers while holding the pavers in their hands to the blade and not following the manufacturer's Safety Precautions and Safety Techniques.

29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee use appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors or potentially injurious light radiation.  a) At the worksite, located at 15400 Willow Ridge Drive, Montverde, FL 34756; On or about 1/22/24, employees were exposed to eye injuries, in that, appropriate eye protection was not utilized while using a Stihl cut-off saw to cut pavers.

29 CFR  1926.1153(c)(1): For each employee engaged in a task identified in Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) At the worksite, located at 15400 Willow Ridge Drive, Montverde, FL 34756; On or about 1/22/24, employees were exposed to respiratory hazards, in that, while cutting pavers, a Stihl cut-off machine (saw) was not equipped with an integrated water delivery system nor did the employer assess the exposure limits of the employees as laid out in 29 CFR  1926.1153  paragraph (d).
