29 CFR  1910.305(j)(1)(iv): Fixtures installed in wet or damp locations were not approved for the purpose and were not so constructed or installed that water could not enter or accumulate in wireways, lamp holders, or other electrical parts:  a.) Stew-Mar, LLC dba Dunkin' - On or about 3/16/24, and at times prior thereto, water was leaking on a ceiling light fixture.  The light was not designed for a wet/damp environment.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR  1910.22(a)(2): The employer did not ensure that the  floor of each workroom is maintained in a clean and, to the extent feasible, in a dry condition. The employer did not ensure that when wet processes are used, drainage is be maintained and, to the extent feasible, dry standing places, such as false floors, platforms, and mats are provided.    a.) Stew-Mar, LLC dba Dunkin, restroom area   - on or about 3/6/24, and times prior thereto:   Water was leaking into the area through a ceiling panel, and a ceiling panel light creating a slip, trip, and fall hazard due to  wet and slippery floor condition.  b.) Stew-Mar, LLC dba Dunkin, front  cashier area  - on or about 3/6/24, and times prior thereto: A broken fitting on the ice/beverage machine caused water to be present on the floor in the area  creating a slip, trip, and fall hazard due to  wet and slippery floor condition.   Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

Stew-Mar, LLC dba Dunkin', drink station: on or about 3/6/24, and times prior thereto: The area around the 5" floor drains were set into the floor ?" creating a potential trip, fall hazard. Stew-Mar, LLC dba Dunkin', front beverage area - on or about 3/16/24, and times prior thereto:  The employer did not certify a personal protective equipment hazard assessment for the entire job processes performed at the facility.  Employees performed work tasks including, but not limited to, cleaning the coffee machines with Tabz Coffee Equipment Cleaning tablets.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). 29 CFR  1910.1200(g)(1):  Employers did not have a safety data sheet in the workplace for each hazardous chemical which they use    a.)Stew-Mar, LLC dba Dunkin', on or about 3/6/24 and times prior thereto:  The company did not maintain safety data sheets onsite for all chemicals at the facility.  Employees worked with and around hazardous substances including but not limited to, Tabz Coffee Equipment Cleaning Tablets during cleaning operations.    ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below).
