29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a)Associated Milk Producers Inc. at 136 West Railway Street, Freeman, SD 57069: On or about and at times prior to March 6, 2024, the employer did not ensure that employees performing maintenance on the fans and motors located on the top of the dryer were protected from fall hazards. This condition exposed employees to fall hazards greater than four feet.

29 CFR 1910.219(f)(3): Sprocket wheels and chains which were seven (7) feet or less above floors or platforms were not enclosed: (a)Associated Milk Producers Inc. at 136 West Railway Street, Freeman SD 57069: On or about and at times prior to March 6, 2024, the employer did not ensure that a rotating chain connected to the Weg NEMA Premium CC028A, Model: 00218ET3DR145TC-S motor was effectively guarded. This condition exposed employees to caught-in and amputation hazards. (b)Associated Milk Producers Inc. at 136 West Railway Street, Freeman SD 57069: On or about and at times prior to March 6, 2024, the employer did not ensure employees were protected from caught-in hazards in that the chain and sprocket, located on the southeast corner of the dryer, was not adequately guarded. This condition exposed employees to caught-in and amputation hazards.
