29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about March 6, 2024, at the above addressed jobsite, an employee using a pneumatic nail gun did not wear safety glasses, thereby exposing the employee to the hazards associated with eye injuries.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.  a. On or about March 6, 2024, the portable ladder used to access the roof did not extend at least three (3') feet above the upper landing surface nor was it secured at the top, thereby exposing employees to the hazards associated with falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a.  On or about March 6, 2024, at the above addressed jobsite, employees performing residential roofing operations, nine (9) feet eight (8) inches above the ground, were not protected from falls, thereby exposing employees to fall hazards.  The Three Vargas, Inc. was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1685023, citation number 1, item number 1 and was affirmed as a final order on August 29, 2023, with respect to a workplace located at 18832 - 18836 Wren Circle, Mokena, IL 60448.
