OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards:   On or about March 7, 2024, at the warehouse storage rack areas where employees were working and walking near damaged racks with bent vertical supports, such as:  a. Storage rack at aisle 11 had a damaged, bent vertical support and continued to be used to store automotive parts and boxes.  b. Storage rack at aisle 24 had a damaged, bent vertical support and continued to be used to store automotive parts and boxes.

29 CFR  1903.2(a)(1):The employer did not post and keep posted OSHA notices informing employees of the protections and obligations provided for in the Act, and that for assistance and information, including copies of the Act and of specific safety and health standards, employees should contact the employer or the nearest office of the Department of Labor. Such notice or notices shall be posted by the employer in each establishment in a conspicuous place or places where notices to employees are customarily posted. Each employer shall take steps to insure that such notices are not altered, defaced, or covered by other material.  On or about March 7, 2024, at the warehouse the employer did not post the OSHA poster in a conspicuous place for employees to view.
