29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  At the temporary jobsite  located at 22108 W. 123 place Olathe, Kansas, the employer failed to develop a written hazard communication program to describe how the program would be implemented to include proper training, labeling, and the administration of safety data sheets, to address their chemicals and products containing Respirable Crystalline Silica, such as stone and cement, which is a skin and respiratory irritant and may cause cancer.

29 CFR  1926.1153(i)(1):The employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200):  At the jobsite located at 22108 W 123 place, Olathe, Kansas, employees performing concrete cutting, pouring, and finishing activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer in that the employer did not include respirable crystalline silica in the program established to comply with the hazard communication standard.

29 CFR  1926.1153(g)(1):The employer did not establish and implement a written exposure control plan:  At the temporary jobsite  located at 22108 W 123 place, Olathe, Kansas, employees performing concrete cutting and drilling activities were exposed to Respirable Crystalline Silica hazards in that the employer had not established and implemented a written exposure control program. Employees were exposed to Respirable Crystalline Silica when performing stone cutting operations.

29 CFR  1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s)  At the jobsite located at 22108 W 123 place, Olathe, Kansas, employees performing masonry activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer. The employer did not maintain copies of the safety data sheets for the products containing Respirable Crystalline Silica including stone and cement.   The employer, CS Stone, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200 (g)(8), which was contained in OSHA inspection number 1708208, citation number 1, item number 1 and was affirmed as a final order on 2-06-2024, with respect to a workplace located at 165 Singletree, Olathe, Kansas.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   At the jobsite located at 22108 W 123 place, Olathe, Kansas, employees performing masonry activities were exposed to hazardous chemicals including but not limited to Respirable Crystalline Silica which is a skin irritant, can cause serious eye damage, respiratory irritation, and may cause cancer without being provided with information and training on how to recognize, avoid and/or eliminate the hazards associated with Respirable Crystalline Silica.   The employer, CS Stone, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.1200 (h)(1), which was contained in OSHA inspection number 1708208, citation number 1, item number 2 and was affirmed as a final order on 2-06-2024, with respect to a workplace located at 165 Singletree, Olathe, Kansas

29 CFR  1926.1153(c)(1):For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1.  At the jobsite located at 22108 W 123 place, Olathe, Kansas, employees performing masonry activities, dry cutting on stone and mixing mortar were exposed to silica hazards. The employer failed to implement engineering and work practice controls as outlined in Table 1 to reduce employee exposure to silica dust.  The employer, CS Stone, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1153(c)(1), which was contained in OSHA inspection number 1708209, citation number 1, item number 5 and was affirmed as a final order on 2-06-2024, with respect to a workplace located at 165 Singletree, Olathe, Kansas.

29 CFR  1910.134(c)(2)(i):Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: (Construction Reference 1926.103)  At the temporary jobsite  located at 22108 W. 123 place Olathe, Kansas, employees performing stone cutting were exposed to Respirable Crystalline Silica hazards in that the employer had not provided respirator users with the information contained in Appendix D to 29 CFR 1910.134. Employees voluntarily used 3M N95 respirators while cutting stones a product containing Crystalline Silica.
