29 CFR 1910.147(c)(5)(i):Locks, tags, chains, wedges, key blocks, adapter pins, self-locking fasteners, or other hardware were not provided by the employer for isolating, securing or blocking of machines or equipment from energy sources: On or about March 7, 2024, an employee engaged in commercial baking activities, located at 1310 Fort Crook Road, Belleview, NE 68005, was exposed to amputation hazards in that the employee was conducting maintenance/cleaning on machinery that was not locked-out in accordance with this subpart. Instances include but are not limited to: i. An employee operating the LC-2727 Operator Slide Machine opened an access port to clear a jam without isolating the hazardous energy source.

On or about March 7, 2024, employees engaged in commercial baking activities, located at 1310 Fort Crook Road, Belleview, NE 68005, were exposed to amputation hazards in that the employees were conducting maintenance/cleaning on machinery that was not locked-out in accordance with this subpart. Instances include but are not limited to: i. An employee operating the LC-2727 Operator Slide Machine opened an access port to clear a jam without fixing a lock as means of isolating the hazardous energy source.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation0. On or about March 7, 2024, employees engaged in commercial baking activities, located at 1310 Fort Crook Road, Belleview, NE 68005, were exposed to amputation hazards in that the employees were authorized by the company to perform cleaning and remove jams on baking equipment without having been trained by the employer on the use and application of the lockout/tagout written specific procedures. Instances include but are not limited to: i. Inadequately trained employees cleaning and removing jams on the LC-2727 Operator Slide Machine, including the incident that resulted in an employee injured as a result of failing to isolate and affix a lock to the energized slide machine.

29 CFR 1904.40(a): The employer did not provide an authorized government representative the records within the four business hours. Bimbo Bakeries failed to provide their OSHA 300 Logs and Form 300A for their facility located at 1310 Fort Crook Road, Belleview, NE 68005 to an authorized OSHA representative within four hours of the representative making both an oral informal and a formal written request for said documents. Instances of failure to respond include but are not limited to: i. On or about March 7, 2024, when OSHA made a verbal request to the company during the opening conference and site walkaround. ii. On or about March 27, 2024, when OSHA made a written request to the company via email.
