29 CFR  1903.19(d)(1):The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  (a) Michael Escobar, failed to document abatement within 10 calendar days after the abatement date that each of the following cited violations had been corrected:  Citation 1, Item 1, a serious violation of 29 CFR 1926.102(a)(1) with an abatement date of July 23, 2024.  Citation 1, Item 2, a serious violation of 29 CFR 1926.501(b)(13) with an abatement date of July 23, 2024.  Citation 1, Item 3, a serious violation of 29 CFR 1926.503(a)(1) with an abatement date of August 12, 2024.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATIONS OF THE CORRECTIVE ACTION WORKSHEET).

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a) On or about March 7, 2024, at the jobsite located at 1561 Bluestem Trail, Oconomowoc WI, employees were installing shingles with pneumatic nail guns without the use of eye protection.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):    (a) On or about March 7, 2024, at the jobsite located at 1561 Bluestem Trail, Oconomowoc WI, employees were installing shingles on the roof of a new residential building with a pitch of 4:12 with a fall height of approximately 24 feet without being tied-off, thereby exposing the employees to a fall hazard.

29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a) On or about March 7, 2024, at the jobsite located at 1561 Bluestem Trail, Oconomowoc WI, employees who were performing roofing work on a new two story residential building  without being tied off and did not have fall protection training.
