The employer did not protect employees working in a trench from falling debris and excavated materials by keeping spoil pile at least two feet from the trench edge. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). a) On or about 03/07/2024 at an excavation located on 69 Hutchings Rd. in Spencerport, NY employees were installing a new sewer line for a residential community. The employer did not protect employees working in a trench more than 5 feet in depth (5ft. 9in.) from cave-in hazards. Sloping or benching, or support and shield systems were not in use. NO ABATEMENT CERTIFICATION REQUIRED
