29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: (a) On or before 3/11/24, the employer did not ensure that employees working in a 6-foot-deep trench were provided with safe and effective egress. A ladder was onsite, but not in use. The employee had to walk to the shallow end of the trench, which was 4 feet deep, to climb out.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. (a) On or before 3/11/2024, the employer did not inspect the trench, the adjacent areas, and the protective systems to ensure hazards were mitigated prior to allowing employee entrance to the trench. A laborer was working in the unprotected trench despite a lack of inspections by a competent person. This condition exposed employees to trench collapse hazards.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c): (a) On or before 3/11/2024, the employer did not protect employees from trench collapse hazards in that an employee was working in a six-foot-deep trench that was 23 feet long and four feet wide. The trench was five feet wide in the area nearest to the excavator. The trench had vertical walls and was comprised of type B soil. The trench was not equipped with protective systems. This condition exposed employees to trench collapse hazards.
