29 CFR  1910.119(e)(1): The employer did not perform an initial process hazard analysis (hazard evaluation) on processes covered by 29 CFR 1910.119:   a. Aerosol Storage Cage - On or about March 12, 2024, the employer failed to perform an initial PHA to identify, evaluate and control hazards of the flammable aerosol storage process in excess of the 10,000 pound threshold quantity. The failure to perform an initial PHA to identify and evaluate flammable aerosol hazards which exposes employees to hazards of fire and explosion from the potential release or ignition of flammables.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.119(h)(2): The employer failed to develop and implement processes and procedures for ensuring the safety of contractors working on and in the process area in accordance with 1910.119(h)(2)(i)-(vi):   a. Aerosol Storage Cage - On or about March 12, 2024, the employer had failed to obtain and evaluate information regarding the contract employer's safety performance and programs; inform contract employers of the known potential fire, explosion, or toxic release hazards related to the contractor's work and the process; explain to contract employers the applicable provisions of the emergency action plan required by paragraph (n) of this section; implement safe work practices consistent with paragraph (f)(4) of this section, to control the entrance, presence and exit of contract employers and contract employees in covered process areas; periodically evaluate the performance of contract employers in fulfilling their obligations as specified in paragraph (h)(3) of this section. By the employer failing to develop and address contractor safety in the process area exposes employees and contractors to fire and explosion hazards from the release of flammables.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.37(a)(4): Safeguard(s) designed to protect employees during an emergency (e.g., sprinkler systems, alarm systems, fire doors, exit lighting), were not in proper working order at all times:  a. Aerosol Cage Exterior Door 16 - On or about March 12, 2024, the emergency exit door sign lighting for use in the event of an emergency was not maintained in working order, employees were exposed to fire and egress hazards.   FedEx Supply Chain was previously cited for a violation of this occupational safety and health standard 1910.37(a)(4), which was contained in OSHA inspection number 1576754, citation number 1, item number 1 and was affirmed as a final order on 7-27-2022, with respect to a workplace located at 3514 Galt Court, Rapid City, SD 57701.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.119(c)(1): The employer did not develop a written plan of action regarding the implementation of the employee participation required by this paragraph.   a. Aerosol Storage Cage - On or about March 12, 2024, the employer had failed to develop a written employee participation plan/program that identified how employees would participate in PSM program development and involvement in the PHA. The failure to develop this program failed to allow for the employees to provide input on the safe handling and storage of aerosols in a warehouse environment, exposing them to fire, and explosion hazards.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
