29 CFR 1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a) Worksite was located at 846 Columbus Drive, Brick, NJ 08724 Workers were replacing an existing retention wall in the backyard of an existing single-family home while in an excavation of mostly type B soil more than seven feet deep with no shoring, a sidewall that was sheer, spoils that were not set back and no competent person doing inspections. Workers were not trained to recognize the hazards associated with trenching in order to safely avoid them. Violation was identified on March 12, 2024.

Workers were permitted to enter the trench when there was evidence of a partial collapse of the sidewall and fissures that were present on the remaining sidewall sections. Violation occurred on or about March 11, 2024.
