29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  a) Worksite was located at 846 Columbus Drive, Brick, NJ 08724  Workers were replacing an existing retention wall in the backyard of an existing single-family home while in an excavation of mostly type B soil more than seven feet deep with no shoring, a sidewall that was sheer, spoils that were not set back and no competent person doing inspections. Workers were not trained to recognize the hazards associated with trenching in order to safely avoid them.  Violation was identified on March 12, 2024.

29 CFR  1926.651(k)(1):Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  a) Worksite was located at 846 Columbus Drive, Brick, NJ 08724  Daily inspections of the trench on site were not being conducted by a competent person. Workers were permitted to enter the trench when there was evidence of a partial collapse of the sidewall and fissures that were present on the remaining sidewall sections.   Violation occurred on or about March 11, 2024.

29 CFR  1926.651(j)(1):Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:  a) Worksite was located at 846 Columbus Drive, Brick, NJ 08724  Two workers were exposed to struck by hazards as they were digging an unprotected trench that was more than seven feet deep in type B soil with a sheer sidewall and no shoring.  Violation occurred on or about March 11, 2024.

Violation occurred on or about March 11, 2024.
