29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). On or about March 12, 2024, a worker was allowed to operate a rough terrain fork (PIV) truck prior to receiving training, exposing employees to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about March 12, 2024, an employee performing construction activities on a walking working surface (roof) were not protected from falls, exposing employees to a fall greater than 25 feet. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.502(d)(17):The attachment point of the body belt shall be located in the center of the wearer's back. The attachment point of the body harness shall be located in the center of the wearer's back near shoulder level, or above the wearer's head. On or about March 12, 2024, employees performing construction activities at height exceeding six feet were using a "Y" lanyards attached to the rescue rings at the front of their harnesses, exposing employees to the hazards associated with improper use of a personal fall arrest system. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
