29 CFR  1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair-rail system along each unprotected side or edge:  On or about March 11, 2024, and times prior thereto, the employer did not ensure the stairway allowing employees to access the second floor area of the home was equipped with a handrail along the unprotected side to allow for safe access to the second floor, thus exposing employees to fall hazards.

29 CFR  1926.1052(c)(12): Unprotected sides and edges of stairway landings were not provided with guardrail systems which met the criteria contained in Subpart M of 29 CFR 1926:  On or about March 11, 2024, and times prior thereto, the employer did not ensure the stairway landing was provided with a guard rail system to protect employees from fall hazards.

29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  On or about March 11, 2024, employees were exposed to flying particles and debris while performing job related duties without appropriate eye or face protection.  Federico Santamaria  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1492770 citation number One (1) , item number Two(2) and was affirmed as a final order on November 3, 2020, with respect to a workplace located at 9349 Trammel Davis Road in Fort Worth, TX.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  On or about March 11, 2024, the employer did not ensure that employees actively performing roof decking installation on the roof of a two story residential home were provided with personal fall protection while working at heights of six feet or greater above the lower level.  Federico Santamaria  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1492770 citation number One (1) , item number Three (3) and was affirmed as a final order on November 3, 2020, with respect to a workplace located at 9349 Trammel Davis Road in Fort Worth, TX.
