29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedures, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:  (a) On March 12, 2024, and times prior, at 5315 U.S. 2 Frontage Road, Minot, ND, the employer did not implement a written energy control program for employees performing maintenance and repairs on various machines including but not limited to CNC machinery, routers, and table saws.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a) On March 12, 2024, and times prior at 5315 U.S. 2 Frontage Road, Minot, ND employees were exposed to entanglement hazards while operating a 2006 Maggi automatic feeder, Type 13701511 on a table saw adjacent to Machine #52 in the east shop where a guard or cover was not protecting employees from rotating feeder wheels.

29 CFR 1910.213(b)(3): Provisions were not made to prevent woodworking machine(s) from automatically restarting upon restoration of power after power failure:  (a) On March 12, 2024, and times prior at 5315 U.S. 2 Frontage Road, Minot, ND employees were exposed to amputation hazards on a Rockwell Unisaw table saw, labeled #10, in the drawer assembly area where no anti restart switch was installed.  (b) On March 12, 2024, and times prior at 5315 U.S. 2 Frontage Road, Minot, ND employees were exposed to amputation hazards on a homemade dado saw, labeled #95, in the drawer assembly area where no anti restart switch was installed.

29 CFR 1910.213(c)(3): Each hand-fed circular ripsaw was not provided with Non kickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator. They shall be designed to provide adequate holding power for all the thicknesses of materials being cut.  (a) On March 12, 2024, and times prior at 5315 U.S. 2 Frontage Road, Minot, ND, a Jet Table saw located in the northeast corner of the east shop adjacent to the Laguna 18 bandsaw, machine #103, was not provided with Non kickback fingers or dogs as required, exposing employees to the hazard of being struck-by wood kicked back by the saw.
