29 CFR  1910.176(a): Handling materials - general. Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked.  a) On or about March 01, 2024,  in the dock-trailer area, the employer did not ensure that there was sufficient safe clearance for the material handling from the dock area towards the back of the aisleway, in that forklifts were assigned to be parked in a non-marked area measuring approximately 20' from the back of the trailers where employees also move loads of steel tubing measuring approximately 21' and 24' in length, exposing employees to pinch point hazards from the steel tubing and the parked forklift.

During hoisting care shall be taken that: The load does not contact any obstructions.   a) On or about March 01, 2024, the employer did not ensure that employees lifting and moving steel tubes were not in contact with any obstructions in the traveling path; in that the load came into contact with a parked forklift while moving a bundle of five (5) steel tubes.

Suspended loads shall be kept clear of all obstructions.   a) On or about March 01, 2024 the employer did not ensure that employees lifting and moving bundles of steel tubes were clear of all obstructions in all directions, either going towards the right, left or backwards with the lifting material including obstructions of parked forklifts.

29 CFR  1910.184(c)(9):  Slings. Safe operating practices. All employees shall be kept clear of loads about to be lifted and of suspended loads.   a) On or about March 01, 2024, the employer did not ensure that employees operating the Kone - TRDG 5 ton Crane #4 kept clear of the loads that are about to be lifted;  while moving it from the trailer to the warehouse/facility area. The employee was guiding and traveling in front of a bundle of steel tubes; as a result, employee's hand got caught in between the steel tubes and a parked forklift, causing an amputation of the left ring finger and permanent damage of the left middle finger.

The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) On or about March 01, 2024, the employer had not ensured that temp employees operating forklifts including the Toyota model 7FGCU35 received adequate classroom and practical training to be competent forklift operators in that temp employees were being asked to operate and moved forklifts throughout the facilities without training.

The load shall be well secured and properly balanced in the sling or lifting device before it is lifted more than a few inches.  a) On or about March 01, 2024 the employer did not ensure that the load being lifted more than a few inches was secured and properly balance before being moved;  in that employees were lifting a bundle of five (5) steel tubes which were three (3) 21 ft. long and two (2) were 24 ft. long at a weight of 390lbs. pounds with just one basket sling in the middle.

When an authorized government representative asks for the records you keep under Part 1904, you must provide copies of the records within four (4) business hours.  a) On or about March 08, 2024, the employer failed to provide OSHA - 300, 300A and 301 Logs within four business hours from the initial opening conference.
