29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  (a)Dakota Plumbing Company at 2804 Cottonwood Circle, Mitchell, SD 57301:  On or about and at times prior to March 12, 2024, the employer did not ensure that employees were trained to recognize and avoid unsafe conditions while conducting work in and around excavations.  This condition exposed employees to various hazards associated with excavation work and construction activities.

29 CFR  1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)Dakota Plumbing Company at 2804 Cottonwood Circle, Mitchell, SD 57301:  On or about and at times prior to March 12, 2024, the employer did not ensure that a safe means of egress was located within 25 feet of the employee conducting work within a multiple direction trench greater than four feet in depth.  This condition exposed employees to hazards associated with inadequate egress.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Dakota Plumbing Company at 2804 Cottonwood Circle, Mitchell, SD 57301:  On or about and at times prior to March 12, 2024, the employer did not ensure that employees were protected from cave-ins while conducting trenching activities.  Employees were conducting sewer line work within a vertical walled trench and no protective system in place greater than five feet in depth.  This condition exposed employees to cave-in hazards from trench wall failure.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions:  (a)Dakota Plumbing Company at 2804 Cottonwood Circle, Mitchell, SD 57301:  On or about and at times prior to March 12, 2024, the employer did not ensure a competent person inspected the excavation prior to start of work and during each shift, in that the competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard.  This condition exposed the employee to struck-by and cave-in hazards.
