29 CFR  1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury:  a) Throughout the mill: On or about March 13, 2024, and at times prior thereto, the employer exposed employees to laceration hazards in that a Lockout/Tagout program was not established consisting of energy control procedures, employee training and periodic inspections to ensure that all hazardous energy was isolated before employees performed servicing or maintenance on equipment, such as but not limited to the Chipper.

29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  Sawmill Area: On or about March 13, 2024, and at times prior thereto the employer exposed employees to struck-by hazards in that employees were allowed to operate a powered industrial truck without the employer first ensuring the employee was competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified by the regulation.

29 CFR  1910.157(c)(4): Portable fire extinguishers were not maintained in a fully charged and operable condition:  a) In the Maintenance Workshop: On or about March 13, 2024, and at times prior thereto, a Kidde 10-pound Class ABC fire extinguisher used by employee fire watches for oxy-acetylene cutting was found to have been depressurized and not in a state of readiness for instant use.  b) At the Main Sawmill: On or about March 13, 2024, and at times prior thereto, a Kidde 15-pound Class ABC fire extinguisher was found to have been depressurized and not in a state of readiness for instant use.
