29 CFR 1926.404(b)(1): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: (a)Dakota Wire Works, Inc. dba Dakota Electric at 11262 West Wind Court, Lead, SD 57754: On or about at times prior to January 16, 2024, the employer did not ensure the flexible cable wired into a breaker panel within a single-family home used to provide power to a portable heater was used with an approved ground-fault circuit interrupter. This condition exposed employees to shock, burns and electrocution hazards. (b)Dakota Electric at 11266 West Wind Court, Lead, SD 57754: On or about at times prior to January 16, 2024, the exposing/creating employer did not ensure an extension cord wired into a breaker within an electrical panel within a single-family home used to provide power to a heater was used with an approved ground-fault circuit interrupter. This condition exposed employees to shock, burns and electrocution hazards.

29 CFR 1926.405(d): Panelboards mounted in cabinets, cutout boxes or enclosures designed for the purpose were not dead front: (a)Dakota Wire Works, Inc. dba Dakota Electric at 11262 West Wind Court, Lead, SD 57754: On or about at times prior to January 16, 2024, the employer did not ensure that an electrical panel was adequately covered in that the dead front cover was removed and placed on the ground in close proximity to the electrical panel. This condition exposed employees to hazards such as shock, burns and electrocution hazards. (b)Dakota Electric at 11266 West Wind Court, Lead, SD 57754: On or about at times prior to January 16, 2024, the exposing and creating employer did not ensure that an electrical panel was adequately covered. The dead front cover was located on the ground in close proximity to the electrical panel. This condition exposed employees to hazards such as shock, burns and electrocution hazards.
