29 CFR 1910.176(a):Permanent aisles or passageways were not appropriately marked: On or about March 8, 2024, the employer failed to ensure the aisleways were marked to identify safe working surfaces for employees who are working around moving powered industrial vehicles in but not limited to the finishing area. Employees were exposed to struck by hazards from the powered industrial vehicles operating in the permanent aisles. The employer did not ensure employees had a safe clearance around the powered industrial trucks .

29 CFR 1910.178(n)(6):Industrial truck drivers were not required to look in the direction of, and keep a clear view of the path of travel: On or about March 8, 2024, the employer failed to ensure an employee operating a powered industrial vehicle kept a clear view of the path of travel. As a result, an employee was exposed to and struck by a CAT Forklift Model HN40980 which led to in-patient hospitalization.
