29 CFR 1915.71(k)(1): Access from below to staging more than 5 feet above a floor, deck or the ground did not consist of well secured stairways, cleated ramps, fixed or portable ladders meeting the requirements of Section 1915.72 or of rigid type non-collapsible trestles with parallel and level rungs: (a) Lee A. Tregurtha, ballast tank 2A and 3; On or about February 27, 2024, and dates prior, employees performing cargo slope plate repair while working from tube and clamp scaffolds more than 5 feet above a floor were exposed to hazards while accessing/egressing the scaffolds due to the lack of safe access.

29 CFR 1915.73(b): When employees were working in the vicinity of flush manholes and other small openings of comparable size in the deck and other working surfaces, such openings were not suitably covered or guarded to a height of not less than 30 inches: (a) Lee A. Tregurtha ballast tank 2A and 3; On or about February 27, 2024, floor holes with an edge approximately 6 feet above a solid surface were not covered or guarded.
