OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee exposed to fall hazards while working from powered industrial trucks: Location: 4 Carol Ave, West Haverstraw, NY a) On or about March 13, 2024 an employee was exposed to fall hazards of approximately 6-7' while standing on the tines and being lifted by a forklift in order to pick merchandise. The employee was not provided with, nor did they utilize any means of fall protection.

29 CFR 1910.176(b): Storage of material created a hazard. Materials stored in tiers were not stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse. a) On or about March 26, 2024, employees working in warehouse at 122 Railroad Ave, West Haverstraw, NY were exposed to being struck by materials that were not stored in a stable and secured manner on storage racks. Material was stacked in partially collapsed boxes on damaged pallets without being secured showing signs of instability that could lead to sliding or collapse. b) On or about March 26, 2024, employees working in warehouse 16 Carol Ave, West Haverstraw, NY were exposed to being struck by materials that were not stored in a stable and secured manner on storage racks. Material was stacked on damaged pallets showing signs of instability that could lead to sliding or collapse. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item, failure to comply will result in an additional penalty of $1,000.00 as per 29 CFR 1903.19.

29 CFR 1910.178(a)(4): Modifications or additions which affect capacity and safe operation of a powered industrial truck were performed by the employer without the manufacturer's prior written approval: Location: 4 Carol Ave, West Haverstraw, NY a) On or about March 26, 2024 modifications and additions which affect capacity and safe operation of a powered industrial truck were performed by the employer without the manufacturer's prior written approval. A forklift tine had an approximately 1.5" hole used to move metal stairs by free rigging, i.e. below-the-tines lift, exposing employees to struck by and/or crush hazards.
