29 CFR 1926.200(g)(2): Traffic control signs and devices: The design and use of all traffic control devices, including signs, signals, markings, barricades, and other devices, for protection of construction workers shall conform to Part 6 of the MUTCD (incorporated by reference, see � 1926.6). a) On or about March 13, 2024, the employer, J&J Schlaegel, failed to protect employees working in an active trench from road users by not implementing key elements of temporary traffic control as required by Part 6 of the MUTCD. Specifically, the employer did not use channelizing devices, provide additional work zone signage, install temporary traffic barriers, or follow a comprehensive Traffic Control Plan (TCP). As a result, employees were exposed to struck-by and crushed-by hazards from traffic.

29 CFR 1926.652(a)(1):Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: (c) of this section except when: 1926.652(a)(1) Excavations are made entirely in stable rock; or 1926.652(a)(1)(ii) Excavations are less than 5 feet (1.52m) in depth and examination of the ground by a competent person provides no indication of a potential cave in. a.) On or about March 6, 2024, located at a residential construction site, employees were exposed to crushed by hazards while working in an 5'7" excavation without adequate protection against cave-ins, in that the walls were not properly shored, benched, or otherwise adequately protected against collapse.
