29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a)  On or about March 18, 2024, and at times prior, the employer did not develop and implement a written respirator protection program with required worksite-specific procedures and elements for employees required to wear half face tight fitting respirators, PAPRS, and those  voluntarily wearing N-95s or half face tight fitting respirators. Employees are required to wear half-face respirators or PAPRs while performing paint gun/booth painting operations during autobody refinishing, exposing employees to the physiological burden of wearing a respirator, and improper use of respiratory protection due to the lack of a written respiratory protection program. The painter did not have a tight seal around their face when wearing a 3M half-face respirator due to facial hair during paint gun/booth painting operations.
