29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a. At a temporally jobsite located at 1 White Hurst Lane, in Palm Coast, FL: On or about March 18, 2024, Florida Roof Specialists, Inc. failed to ensure that its sub-contractor The Brothers Platinum Roof, Inc. protected its employees from fall hazards, in that the employees were allowed to use a ladder that the rails did not extend 3 feet above the upper landing surface of the roof at the eave and ladder was not secured at its top to a rigid support that will not deflect.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Employees performing roofing work at elevations of six feet or more above the ground are not being protected from fall hazards by a fall protection system: Florida Roof Specialists, Inc. fails to assure effective protection against fall as required by the standard, as demonstrated on March 18, 2024, when eight (8) subcontracting employees performing roofing work on a 5:12 roof pitch of a house located at 1 White Hurst Lane, in Palm Coast, Florida, were exposed to the fall hazards, in that subcontracting employees did not use fall protection system. The Florida Roof Specialists, Inc. was previously cited for a Serious violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1596522, citation number 1, item number 2, and was affirmed as a final order on 07-20-2022, with respect to a workplace located at 9447 Thorn Glen Road in Jacksonville, Florida 32208.
