29 CFR  1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)Dakota Storm Roofing, LLC at 120 West 4th Street, Pierre, SD  57501:  On or about and at times prior to March 18, 2024, the employer did not ensure employees were protected from flying particles in that employees were using pneumatic power tools without eye protection while working on the roof of a residence.  This condition exposed employees to eye and face and injuries due to flying particles hazards.

29 CFR  1926.501(b)(13): Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)Dakota Storm Roofing, LLC at 120 West 4th Street, Pierre, SD  57501:  On or about and at times prior to March 18, 2024, the employer did not ensure that employees were protected from falls during roofing operations on a residential property due to no fall protection system in place.  This condition exposed the employees to a fall hazards greater than six feet.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a)Dakota Storm Roofing, LLC at 120 West 4th Street, Pierre, SD  57501:  On or about and at times prior to March 18, 2024, the employer did not ensure employees were protected from falls in that the portable extension ladder used to access the roof on the north side of the residential property did not extend at least three feet above the upper landing surface being accessed.  This condition exposed employees to falls and fall-related hazards.  (b)Dakota Storm Roofing, LLC at 120 West 4th Street, Pierre, SD  57501:  On or about and at times prior to March 18, 2024, the employer did not ensure employees were protected from falls in that the portable ladder used to access the roof on southwest corner of the residential property did not extend at least three feet above the upper landing surface being accessed.  This condition exposed employees to falls and fall-related hazards.
